§ 1 Scope and contractual partner

(1) These General Terms and Conditions ("GTC") apply to all contracts for sport-psychological coaching, team support, workshops and talks concluded between Nathalie Klingebiel ("the provider") and clients, clubs or commissioning parties.

(2) Consumers are natural persons who conclude a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).

(3) Only these GTC apply. Deviating terms do not become part of the contract unless expressly agreed in writing.

§ 2 Services

(1) The provider offers sport-psychological services, in particular individual coaching, team support, workshops and talks with a focus on football and team sports.

(2) The exact scope is set out in the respective service description on the website or in the individual offer.

(3) The services do not replace medical or psychotherapeutic treatment. They are aimed at generally healthy athletes and teams. In case of existing conditions, please seek medical or therapeutic advice in advance.

§ 3 Conclusion of contract

(1) The presentation of services on the website is not a binding offer but a non-binding invitation to book.

(2) By submitting a request or booking, the client makes a binding offer. The contract is concluded when the provider confirms the booking in text form (e.g. by email).

(3) The contractual language is German; English versions are provided for convenience.

§ 4 Prices and payment

(1) The prices stated at the time of booking apply.

(2) Payment methods: bank transfer in advance, or other methods stated at booking.

  • Single booking: due before the service is rendered.
  • Package booking: due in full at the time of booking.
  • Team / club services: as agreed in the individual offer.

§ 5 Appointments, cancellations

(1) Appointments are arranged individually unless a fixed slot is booked.

(2) Individual appointments may be rescheduled free of charge up to 24 hours before the start. Later cancellations or no-shows may be invoiced in full.

(3) For packages or team services, missed appointments expire unless otherwise agreed.

§ 6 Right of withdrawal for consumers

(1) Consumers have a statutory right of withdrawal. The detailed instructions are provided before contract conclusion.

(2) Expiry of the right of withdrawal for services: the right expires once the provider has fully performed the service and only began performance after the consumer explicitly consented and acknowledged that the right would be lost upon full performance.

§ 7 Confidentiality

The provider treats all information shared during coaching or sport-psychological work as confidential. Information is shared with third parties (club, coach, family) only with the client's explicit consent, unless legal disclosure obligations apply.

§ 8 Liability

(1) Unlimited liability for damages from injury to life, body or health and for intent or gross negligence.

(2) Otherwise, liability for slight negligence is excluded unless essential contractual obligations are breached. In that case liability is limited to the foreseeable damage typical for the contract.

(3) Clients are responsible for their own health and fitness for the booked services.

§ 9 EU dispute resolution

The European Commission provides an ODR platform: https://ec.europa.eu/consumers/odr/. The provider is not willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 10 Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of their habitual residence.

(2) If any provision is invalid, the remaining provisions remain unaffected.

(3) Changes or additions require text form.
